Service Overview

The temporary residence and employment authorization is intended for foreign nationals who wish to work in Spain for a company or employer, simultaneously obtaining the right of residence and work. This allows the exercise of a labor activity as an employee, under the conditions set in the administrative resolution, and may be limited to a specific territorial scope, sector of activity, or employer, especially in initial authorizations. This is one of the ordinary avenues of access to the Spanish labor market for foreign nationals, facilitating their professional and social integration in accordance with the legal framework established in immigration regulations.

Legal Requirements

Legal Requirements

1
National Employment Situation
On a quarterly basis, the Public State Employment Service ("SEPE") will prepare a catalog of occupations that are difficult to cover, allowing the hiring of foreign nationals. Likewise, depending on the agreements that Spain has with third countries, or if we are talking about seasonal activities, the national employment situation will not always apply.
2
Employment Contract
It must be signed by the company or employer and by the worker. The worker, depending on the case, must accredit having the professional training required for the profession. The start date of the contract must be conditioned upon the effective date of the residence authorization, and the conditions must comply with current regulations as well as the relevant collective bargaining agreement.
3
No Criminal Record and Not Posing a Threat to Public Order, Security, or Public Health
Not only must you have no criminal record in Spain, but also in the countries where you have resided during the last five years prior to the date of entry into Spain, for offenses provided for in the Spanish legal system. The purpose of this requirement is to guarantee a safe coexistence in accordance with current regulations.
4
Not Appearing as Rejectable nor Finding Yourself Within the Non-Return Period to Spain
In this case, it would apply to countries with which Spain has signed some type of agreement where they do not accept individuals who have been banned from entry by said country.
5
Payment of the Fee
As in most administrative procedures, the application involves the payment of the corresponding fee, which must be settled within the established period so that the process can continue correctly.
6
Regarding the Employer
The employer must be up to date with their obligations, both tax and Social Security, as well as have sufficient economic, personal, and material means to fulfill the obligations contained in the employment contract.
